Summer Camp Consent

PARENTAL CONSENT & AGREEMENT: In consideration of my child or children’s participation in the activities listed below on the date and at the location above (the “Activity”), I, being the parent or legal guardian of the Participant(s) identified on this form (the “Participant”), consisting of one or more children, hereby consent to the participation of each Participant in the activities of the 2027 Highlander Camp.

Activities include shelter building, whittling, archery contests, axe throwing contests, canoeing, white water rafting, pig slaughter, knife throwing contests, pilgrimage to Scranton, tug of war, caber toss, cardboard boat building and sailing on a small pond, day trips and hikes to local nature reserves and parks, soccer games, basketball games, capture the flag, juggling instruction, flag football, kickball, dodgeball, and chicken slaughter.

I represent that each Participant is in good health and in proper physical condition to participate in the above-referenced activities. Further, I certify that each Participant is physically able and adequately trained to participate in such activities, including swimming.

I understand and acknowledge the physical rigors associated with the above-referenced activities and/or the use of related equipment and understand that participation involves risks and dangers, including, without limitation, serious bodily injury, permanent disability, disease, strains, fractures, partial and/or total paralysis, eye injury, blindness, heat stroke, heart attack, death, inaccessibility of medical care, dangers arising from adverse weather conditions, inadequate safety measures, participants of varying skill levels, situations beyond the immediate control of Highlander Camp, other harm or damage that may not be readily foreseeable, and other presently unknown risks and dangers (collectively, the “Risks”).

I understand that these Risks may be caused in whole or in part by a Participant’s own actions or inactions, the actions or inactions of others participating in the activities, or other causes. Understanding these Risks, I expressly authorize and give permission for each Participant to participate in any and all of the above-referenced activities.

I also give permission to the camp staff to inspect the contents of any or all of a Participant’s personal belongings and to withhold any unapproved items. I understand that if any Participant misbehaves or violates the camp rules, I may be required to pick up that child from camp.

GENERAL RELEASE AND ASSUMPTION OF RISK:

Knowing the risks described above, I, being the parent or legal guardian of the Participant(s), agree to assume all risks and responsibilities, known and unknown, associated with my child’s or children’s participation in Highlander Camp 2027.

To the maximum extent permitted by law, I release, hold harmless, and agree to indemnify Gregory the Great Academy and its officers, directors, employees, volunteers, and agents from and against any present or future claims, losses, liabilities, costs, and expenses for injury to person or property, or for any other damage that I may suffer or for which I may be liable to any other person, arising out of or related to the participation of any Participant in Highlander Camp (including periods in transit to or from the camp), resulting from any cause, including, but not limited to, negligence on my part or on the part of any of the released parties; provided, however, that this release of liability shall not apply to gross negligence or willful or wanton misconduct.

I warrant that I have read this Agreement carefully, understand its terms and conditions, and acknowledge that I am giving up substantial legal rights by signing it. I acknowledge that I have signed this Agreement freely and voluntarily, without any inducement, assurance, or guarantee.

This Agreement represents the complete and entire understanding between the parties regarding the matters addressed herein, and no oral representations, statements, or inducements have been made apart from this Agreement.

If any provision of this Agreement is held to be unlawful, void, or unenforceable for any reason, that provision shall be deemed severable from this Agreement and shall not affect the validity or enforceability of the remaining provisions.

I expressly waive any defense to the enforcement of any provision of this Agreement arising from a claim of lack of consideration and warrant that this Agreement constitutes a legal, valid, and binding obligation enforceable against me in accordance with its terms.

I expressly agree that this assumption of risk, release, and indemnity agreement is intended to be as broad and inclusive as permitted by law.

I FURTHER STATE THAT I HAVE CAREFULLY READ THIS AGREEMENT, UNDERSTAND ITS CONTENTS, AND VOLUNTARILY SIGN THIS AGREEMENT AS MY OWN FREE ACT.

I understand and agree that no oral or written representations can or will alter the contents of this Agreement.

I agree that this Agreement shall be governed by the laws of the Commonwealth of Pennsylvania, which shall be the exclusive forum for any lawsuit arising under or relating to this Agreement or the above-described activities.

A photocopy or facsimile of this consent and release shall be as valid as the original.

 

PHOTOGRAPH & VIDEO RELEASE

I, the parent or legal guardian of the Participant(s), hereby grant Highlander Camp and Gregory the Great Academy permission to use each Participant’s image, likeness, and voice as recorded in photographs, audio recordings, or video recordings without payment or any other consideration.

I understand that each Participant’s image, likeness, and voice may be edited, copied, exhibited, published, or distributed, and I hereby waive the right to inspect or approve the finished product in which any Participant’s likeness appears. Additionally, I waive any right to royalties or other compensation arising from or related to the use of any Participant’s image, likeness, voice, or recording.

I agree that Highlander Camp and Gregory the Great Academy may use such images, likenesses, and recordings of each Participant, with or without the Participant’s name, for any lawful purpose, including, but not limited to, publicity, illustration, advertising, promotional materials, and web content.

I understand that there is no time limit on the validity of this release and no geographical limitation on where these materials may be used or distributed.

I acknowledge that I have completely read and fully understand this release and agree to be bound by its terms.

I further agree to defend, indemnify, and hold harmless Highlander Camp and Gregory the Great Academy from and against any and all claims arising out of, resulting from, or in any way relating to the authorized use of any Participant’s image, likeness, or voice as provided in this release.

A photocopy or facsimile of this authorization shall be as valid as the original.
